Avril Lavigne is in trouble after a band called The Rubinoos (no, us neither) claimed she copied them on her recent Girlfriend number 1 hit.

The songwriters behind the band are filing a lawsuit saying the song is nicked from their hit I Wanna Be Your Boyfriend (no, us neither).

Avril-whos married to Sum 41 singer Deryck Whibley- is already known for being stroppy and this wont make her any happier.

We just hope Hey Mickey singer Toni Basle hasnt heard Girlfriend or Lavigne will have even more money to pay out!
