Black Eyed Peas Sued… Again

Group hit with second plagiarism lawsuit this year…

The Black Eyed Peasare being sued by a Texan songwriter who claims I Gotta Feeling is based on one of his songs.

A lawsuit filed by Bryan Pringle alleges that his track Take A Dive, which was written in the 90s, is similar to the 2009 chart-topper. He claims that he sent a demo of the song to several record companies over the years, including BEP’s label Interscope, but received no reply.

This latest lawsuit was filed on the same day that an older suit, dating back to January, was resubmitted to court. Singer Phoenix Phenom launched a copyright claim against the Black Eyed Peas, alleging Boom Boom Pow was a rip off of her track Boom Dynamite, which was submitted to Interscope a year before the Peas hit was released.

“A simple listening of the two songs will tell you that the songs are substantially similar, and that the hooks of the two songs are virtually identical in rhythm and lyrics,” a lawyer acting for Phoenix Phenom said.

Both cases are being looked after by the same law firm and both claim that BEP and Interscope engaged in “a pattern and practice of intentional copyright infringement with respect to the unlawful copying of songs of unknown or lesser-known artists”.

Both lawsuits are seeking damages including profits from the global hits and future royalties.
