The Mean Girls star had originally claimed that she never gave Pitbull permission to use her name in the song, seeking profits from the tune.
According to TMZ, a New York federal judge ruled yesterday (February 21) against Lohan, arguing that as a form of artistic expression, the track is protected under the First Amendment to the United States Constitution.
They went onto rule out Lindsay's claims, adding that her name was hardly mentioned in the song.
